Terms of Use
These Terms and Conditions set forth the terms of use between “FXplus” (hereinafter referred to as “the Service”) and the individuals and corporations that use the Service (hereinafter referred to as “Users”), and shall apply to all relationships arising from the use of the Service.
FXplus Terms of Use
Article 1 (Definitions in These Terms and Conditions)
The following terms used in these Terms and Conditions shall have the meanings set forth below.
- "This Service": "FXplus," an overseas FX account opening agency service
- "Users": Individuals and legal entities who use the service
- "This Site": The website used to provide and announce this service
- "Various Brokers": Overseas FX brokers (firms) with which we have partnerships
Article 2 (Scope and Amendments to These Terms)
These Terms and Conditions govern the relationship between the Company and users of the Service. Furthermore, the Company reserves the right to amend these Terms and Conditions without obtaining the users’ consent due to the enactment, amendment, or repeal of laws, regulations, or other relevant provisions. In such cases, the amended Terms and Conditions shall take effect as of the time they are posted on the Service’s website.
Article 3 (Establishment of the Usage Environment)
Users shall, at their own expense and under their own responsibility, prepare the communication equipment, software, and all other equipment necessary for using this Service, and ensure that this Service is available for use. Furthermore, users shall connect to this Service via any telecommunications service of their choice, at their own expense and under their own responsibility.
Article 4 (Registration Procedures, etc.)
Users shall be solely responsible for managing the details of their applications when using this Service. User information and other data provided upon registration will be stored in the Service’s database for operational purposes, and such information shall be used solely for the purposes of this Service.Furthermore, if any application falls under any of the following categories, this Service may refuse to accept the application, terminate the relevant contract, or deny future use of this Service.
- If an application is submitted with false information
- If the user in question has previously failed to fulfill their contractual obligations under this Service
- If we determine that it is difficult to continue providing this service for reasonable grounds
- In addition, if we determine that there is a significant impediment to the performance of our business operations
Article 5 (Prohibition on Changes to Registered IB Information, etc.)
If a user opens an account with a broker through this Service or through various online advertising campaigns conducted by the Company, the user shall not change the IB (Introducer) for that account; the same applies to any additional accounts.
Article 6 (Scope of Personal Liability)
Users shall bear full responsibility for their use of the Service, for all transactions conducted with individual brokers through the Service, and for the results thereof.Furthermore, if a user causes damage to this Service or to any third party through the use of this Service (including cases where a third party or this Service suffers damage due to the user’s failure to fulfill their obligations under these Terms), the user shall compensate for such damage at their own responsibility and expense.
Article 7 (Scope of Disclaimer)
This Service may be temporarily suspended without prior notice to users if any of the following circumstances arise.
- When performing regular or emergency maintenance on equipment and other facilities used for this service
- In the event that we are unable to provide this service due to a fire, power outage, or other similar circumstances
- If we are unable to provide this service due to natural disasters such as earthquakes, volcanic eruptions, floods, or tsunamis
- In the event that we are unable to provide this service due to war, civil unrest, riots, disturbances, labor disputes, or similar events
- In cases resulting from malfunctions, maintenance, or other issues related to the equipment or systems used by our company
- In addition, if we determine that a temporary suspension of the Service is necessary for operational or technical reasons
The Company shall not be liable for any damages incurred by Users or third parties resulting from any delay or interruption in the provision of the Service due to any of the items listed in the preceding paragraph or any other cause, except as specifically provided for in these Terms of Service.
Article 8 (Protection of Personal Information)
This service will handle personal information and similar information appropriately in accordance with the “Privacy Policy.”
Article 9 (Exclusive Jurisdiction)
In the event of any litigation arising between a user and this Service, the Commercial Court with jurisdiction over our head office shall be the exclusive agreed-upon court of first instance.
Article 10 (Important Notes Regarding International Use)
Users shall fully understand that the Internet is used across national borders and shall comply with the regulations of the country or region in which they use the Internet or reside.
Supplementary Provisions
These Terms of Use will take effect on November 11, 2010.
