Terms of Use
These Terms and Conditions set forth the terms of use between "FXplus" (hereinafter referred to as "the Service") and the individuals and corporations that use the Service (hereinafter referred to as "Users"), and shall apply to all matters arising from the use of the Service.
FXplus Terms of Use
Article 1 (Definitions in These Terms and Conditions)
The following terms used in these Terms and Conditions shall have the meanings set forth below.
- "This Service": "FXplus" Overseas FX Account Opening Agency Service
- "User": Any individual or legal entity using the service
- "This Site" The website used to provide and announce this service
- "Each Broker" Overseas FX brokers (providers) with which we partner
Article 2 (Scope and Revision of These Terms)
These Terms and Conditions govern the relationship between the Company and users of the Service. The Company reserves the right to amend these Terms and Conditions without prior consent from users due to the enactment, amendment, or repeal of laws and regulations, or for other reasons. In such cases, the amended Terms and Conditions shall take effect upon their posting on the Service’s website.
Article 3 (Provision of the User Environment)
Users shall, at their own expense and responsibility, prepare all communication equipment, software, and other necessary devices required to use the Service, and ensure that the Service is available for use. Furthermore, users shall connect to the Service via any telecommunications service of their choice, at their own expense and responsibility.
Article 4 (Registration Procedures, etc.)
When using this Service, users are responsible for managing the details of their applications. User information and other data provided during registration will be stored in the Service’s database for operational purposes and will be used solely for the purposes of this Service. Furthermore, if an application falls under any of the following categories, this Service may refuse to accept the application, terminate the relevant contract, or deny future use of the Service.
- If an application is submitted with false information
- If the user in question has previously failed to fulfill their contractual obligations under this Service
- If we determine that it is difficult to continue providing this service for reasonable grounds
- In addition, if we determine that there is a significant impediment to the performance of our business operations
Article 5 (Prohibition on Changing Registered IB Information, etc.)
If a user opens an account with a broker through this Service or through any of the advertising campaigns we conduct online, the user shall not change the IB (Introducing Broker) for that account; the same applies to any additional accounts.
Article 6 (Scope of Personal Liability)
Users shall bear full responsibility for their use of the Service, all transactions conducted with brokers through the Service, and any resulting consequences. Furthermore, if a user causes damage to the Service or to any third party through the use of the Service (including cases where the Service or a third party suffers damage due to the user’s failure to fulfill their obligations under these Terms), the user shall compensate for such damage at their own expense and liability.
Article 7 (Scope of Disclaimer)
We may temporarily suspend this service without prior notice to users if any of the following circumstances arise.
- When performing regular or emergency maintenance on equipment used for this service
- If we are unable to provide this service due to a fire, power outage, or other similar circumstances
- If we are unable to provide this service due to natural disasters such as earthquakes, volcanic eruptions, floods, or tsunamis
- If we are unable to provide this service due to war, civil unrest, riots, disturbances, labor disputes, or similar events
- In cases where the issue is caused by malfunctions, maintenance, or other reasons related to the equipment or systems we use
- In addition, if we determine that a temporary suspension of the Service is necessary for operational or technical reasons
The Company shall not be liable for any damages incurred by Users or third parties resulting from any delay or interruption in the provision of the Service due to any of the items listed in the preceding paragraph or any other cause, except as specifically provided for in these Terms of Service.
Article 8 (Protection of Personal Information)
This service will handle personal information and similar data appropriately in accordance with our "Privacy Policy."
Article 9 (Exclusive Jurisdiction)
In the event of any litigation arising between the user and this Service, the Commercial Court having jurisdiction over our head office shall be the exclusive agreed-upon court of first instance.
Article 10 (Important Notes Regarding International Use)
Users shall use the Internet with a full understanding that it is a cross-border medium and shall comply with the regulations of the country or region in which they use the service or reside.
Supplementary Provisions
These Terms of Use will take effect on November 11, 2010.
